Disclaimer and Liability Waiver

Food matters and we want to help you discover the food and lifestyle that works best for you. We are nutrition counselors who want to help you learn how to eat healthier, look great and feel great. We are not doctors. We do not know your personal medical history or the medications you may be taking, and for this reason it is important that you consult your physician before making changes in your health regime.

Kale + Co. does not claim that our food will alleviate, cure or heal any health condition or symptom. Our meals and meal programs are not meant to treat any medical condition.

Food is perishable. By purchasing Kale + Co., you agree to properly and promptly refrigerate all meals until you plan to eat them. Since all of our food is fresh (preservative-free, chemical-free, etc.) it can spoil quickly if not properly taken care of. So, once the food is delivered to you, it is in your hands and Kale + Co. cannot and will not be responsibility for any spoilage and/or other change in condition of any of its products after delivery to you.

GENERAL

Welcome to the website ("Site") of Kale + Co., LLC ("we", "us", "our" or "Kale + Co."). Please review the following basic terms that govern your use of, and purchase of products from, our Site. Please note that your use of our Site constitutes your agreement to follow and be bound by these terms (the "Agreement"). We may from time to time change the terms that govern your use of our Site. Such change will be effective immediately upon notice, which may, at our discretion, be posted as a modified agreement on the Site or sent out via email. Your use of our Site following any such change constitutes your agreement to follow and be bound by the terms and conditions as changed.

PAYMENTS AND PROMOTIONS

Payment is due upon purchasing any Kale + Co. product. If you are using a promotion or a discount code, please enter it at checkout to receive an immediate discount. Only one promotion or discount code may be used per order. Promotion or discount codes may not be used on already discounted programs. Holiday and other special promotions may, at the option of Kale + Co., carry specific terms and conditions, and we reserve the right to create, amend, and enforce said terms, conditions, and restrictions.

If you have joined the Kale + Co. Monthly Meal Club, delivery will be on the first Sunday of every month. (Please confirm available dates on our website) If you need to change the date, please contact as soon as possible. The club is for a five day meal program only. Each month your credit card will be automatically debited through our Paypal system.

CANCELLATIONS & REFUNDS

We are committed to getting you healthy and we want you to commit to that goal as well!

Orders may be cancelled for a 100% refund up to 7 days prior to your delivery date. If you cancel less than 7 days prior to the start of your scheduled delivery, we will refund 50 %. You may also opt to put your order on hold and start/resume at a later date, or have it sent to someone else.

Refunds will not be issued for delays that are the result of factors outside Kale + Co.'s reasonable control including, but not limited to, weather and traffic. If we cancel your delivery, you will be notified by email, and the number of meals canceled will be automatically added to the end of your program. If this does not suit your schedule, please let us know and we will do our best to find a better arrangement.

If you have joined the Kale + Co. Monthly Meal Club you have committed to a five day meal plan, once a week, for four months. . You can put one month on hold and resume for a future date. After four months, you can cancel at anytime per Kale + Co.'s cancellation policy.

DELIVERY SCHEDULE AND DISCLAIMER

We deliver on Sunday and Tuesday evenings. 5 day or more meal programs will receive orders on both days.  You will receive food on Sunday evenings for Monday and Tuesdays meals and on Tuesday evening for Wednesday, Thursday and Friday meals. We do not supply meals for the weekends.

Our meal programs are scheduled according to availability and begin on Monday mornings. We cannot guarantee that a certain date is available to start the meal program as spots fill up quickly. The cut-off time for the program sign-up is 11:59PM on the Monday preceding the cleanse date. You can check our website for the next upcoming cleanse.

We will do our best to deliver your meals to you in accordance with your specifications. However, if we are not successful in our attempt, our delivery team will leave the box at your location in the place they deem to be the safest and cleanest. We will email you as soon as possible if this is the case.

DELIVERY COST

Deliveries are $10 for sales between $50-99. Deliveries are $15 for sales totally $100 or more. 

 

INACCURACY DISCLAIMER

From time to time there may be information on the Kale + Co. website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). We apologize for any inconvenience this may cause you.

INDEMNIFICATION

You agree to defend, indemnify and hold Kale + Co. harmless from and against any and all claims, damages, costs, judgments, causes of action, suits, liabilities, and expenses of any nature whatsoever (including, without limitation, attorneys' fees and disbursements), arising directly or indirectly from or related to your use of our products or nutritional guidance.

PRIVACY POLICY

We respect and protect your privacy online. We do not sell or rent your information to third parties; however, the information we do collect, (i.e. your name, address, billing and contact information) is saved when you place an order in order to process your order. In order to confirm your order, we send you emails for confirmation and in special cases may need to contact you via phone or postal mail if we have additional questions regarding your order. We do not authorize any third parties to make any other use of your information other than that which assists us in processing and fulfilling your order. Our website may contain links to other sites that are out of our control. Please review these sites' separate policies regarding privacy for your convenience.
